1. Acceptance of Terms

By accessing, browsing, or placing an order with Enchanted Designs Ltd. (including our website, live sales, and affiliate program), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services. We reserve the right to update these terms at any time without prior notice. Continued use after changes are posted constitutes acceptance of the revised terms.

2. Definitions

  • "Alberta Ammolite" refers to genuine fossilized ammonite shell mined exclusively in Southern Alberta, Canada, from the Bearpaw Formation.
  • "Listing" refers to a product offered for sale on our website, which may be a single item or one of multiple identical or numbered units.
  • "Multi-stock" refers to listings where multiple individual numbered units (e.g., #1, #2, #3) of the same product are available.
  • "Live sale" refers to items sold during TikTok Live broadcasts.

3. Products & Authenticity

  • All ammolite is authentic Alberta Ammolite sourced from licensed claims in the Lethbridge Mining District. We are members of the Association of Applied Paleontological Sciences (AAPS), American Gem Trade Association (AGTA), and include GIA Alumni.
  • Ammolite is a natural material. Color, pattern, brilliance, and size variations are inherent. Each piece is unique. Photos are taken to represent the item as accurately as possible, but natural lighting and screen display differences may cause slight variations.
  • Grading labels (A, AA, AAA, Museum, Collector) reflect our professional assessment based on color range, brilliance, stability, and rarity. Grading is subjective and not an industry-certified standard.
  • Most listings are one-of-a-kind. Once sold, the exact item cannot be replicated.
  • Multi-stock listings feature multiple units of similar items (e.g., lucky stones). Each unit is individually numbered. You may select specific unit numbers during checkout (subject to availability).

4. Pricing, Currency & Taxes

  • All prices are listed in Canadian Dollars (CAD) unless otherwise specified. Website displays support CAD and USD currency selection for reference only — all payments are processed in CAD.
  • Exchange rates shown on our website are for estimation purposes. Your final amount charged may vary depending on your payment provider's exchange rate and any bank or foreign transaction fees.
  • Prices are subject to change without notice. The price displayed at the time you complete checkout is the price you pay.
  • GST (Goods and Services Tax) will be calculated and applied to Canadian orders where applicable. International orders are exempt from Canadian GST but may be subject to import duties and taxes in the destination country (buyer's responsibility).

5. Bundle Discounts

Bundle discounts are applied automatically during checkout based on eligible items in your cart:

  • Lucky Stones: 5% off per eligible item (max 25% total discount).
  • Full Ammonite Fossils: 15% off per eligible item (max 25% total discount).
  • Discounts apply only to the qualifying items, not the entire cart.
  • The total bundle discount is capped at 25% regardless of item count.
  • Bundle discounts may be combined with affiliate codes or coupon codes at our discretion.
  • Jewelry, certain premium items, and items already marked as on-sale may be excluded from bundle discounts.

6. Affiliate Program & Discount Codes

  • Affiliate codes provide discounts to customers and commissions to affiliates. Codes are personal and non-transferable.
  • Affiliate discounts apply only to eligible items and may be combined with bundle discounts.
  • Misuse of affiliate codes (spam, fraud, unauthorized promotion) may result in code deactivation and account termination.
  • Coupon codes and promotional codes are subject to expiration dates, usage limits, and exclusions as specified.
  • We reserve the right to refuse or revoke any discount code at our sole discretion.

7. Orders & Payment

  • Orders are accepted via our website and during TikTok Live sales. Payment is processed through PayPal (PCI-DSS compliant).
  • All payments must be completed within 48 hours of order placement. Unpaid orders will be cancelled and items returned to inventory.
  • Once payment is confirmed, your item(s) are reserved and marked as SOLD. For multi-stock listings, the specific unit number(s) you purchased are locked to your order.
  • Live sale purchases are first-come, first-served based on comment timestamps or our discretion if multiple claims occur simultaneously.
  • We reserve the right to refuse, cancel, or limit any order for reasons including but not limited to: pricing errors, stock discrepancies, suspected fraud, or violation of these terms.

8. Shipping & Delivery

  • We ship worldwide from Southern Alberta, Canada. Standard shipping rates are calculated automatically at checkout based on weight and destination.
  • For large fossils, custom orders, or international shipments, we may provide a manual shipping quote. Quoted shipping fees are binding once accepted.
  • Estimated delivery times vary by destination and carrier. We are not responsible for delays caused by carriers, customs, weather, or other factors beyond our control.
  • Tracking information will be provided once your order ships. It is your responsibility to monitor tracking and arrange delivery or pickup if required.
  • Risk of loss passes to you upon delivery to the carrier. We strongly recommend purchasing shipping insurance for high-value items.
  • International buyers are responsible for all import duties, customs fees, and taxes imposed by their country. These fees are not included in our prices.

9. Returns, Exchanges & Refunds

  • Due to the one-of-a-kind nature of natural specimens, all sales are generally final.
  • If your item arrives damaged or is significantly different from its listing description, contact us within 48 hours of delivery with photos. We will assess the issue and offer a replacement, partial refund, or full refund at our discretion.
  • Natural variations in color, pattern, or size are not grounds for return. Please review listing photos, videos, and descriptions carefully before purchasing.
  • Returns for damaged items must be shipped back securely. Return shipping costs are the buyer's responsibility unless the damage occurred during our initial shipment.
  • Refunds will be issued to the original payment method within 7-14 business days of approval.

10. Order Revocation

In rare cases, we may revoke an order after payment (e.g., stock error, damage discovered before shipping, or suspected fraud). If revoked, your payment will be refunded in full and items will be returned to inventory. You will be notified by email with an explanation.

11. User Accounts

  • You may create an account to track orders, save shipping details, and participate in the affiliate program.
  • You are responsible for maintaining the confidentiality of your account password and for all activity under your account.
  • We reserve the right to suspend or terminate accounts that violate these terms, engage in fraud, or abuse our platform.

12. Intellectual Property

  • All content on this website, including text, images, videos, logos, branding, and design, is the property of Enchanted Designs Ltd. and is protected by Canadian and international copyright law.
  • "Authentic Alberta Ammolite" and "Enchanted Designs" are trademarks of Enchanted Designs Ltd.
  • You may not reproduce, distribute, or create derivative works from our content without express written permission.

13. Limitation of Liability

To the fullest extent permitted by law, Enchanted Designs Ltd. shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages arising from the use of our website, products, or services.
  • Damages resulting from shipping delays, lost packages, or customs issues.
  • Damages caused by third-party payment processors, carriers, or service providers.
  • Loss of profits, data, or business opportunities.

Our total liability is limited to the purchase price of the item(s) in question.

14. Indemnification

You agree to indemnify and hold harmless Enchanted Designs Ltd., its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these terms or misuse of our services.

15. Governing Law & Dispute Resolution

These Terms & Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of our services shall be resolved exclusively in the courts of Alberta. By using our website, you consent to the jurisdiction of these courts.

16. Severability

If any provision of these terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect.
